Kiaran Stapleton cousin banned from family home

The cousin of convicted murderer Kiaran Stapleton has been banned from his family home in Salford after breaching a court order.

Andrew Burgess, 37, has been banned from the property in Regent Square, Ordsall, after breaching the terms of a five-year Suspended Possession Order (SPO), which prevents anyone at the house being involved in criminal activity.

The property is home to Billie Jean Stapleton, 48, and Anthony Stapleton, 51, who were served with the SPO in July 2013 after their son Kiaran Stapleton was convicted of murdering Indian student Anuj Bidve.
Salix Homes, in conjunction with New Barracks Co-operative, sought legal action against the Stapletons after their nephew Burgess, who had allegedly been living at the property, was arrested at the property in April 2014, on suspicion of breaking into a garage on Fairbrother Street in Ordsall with intent to steal. He was later convicted of the offence and jailed for 16 weeks.

A trial was due to take place at Manchester Civil Justice Centre yesterday (Wednesday, January 7) however ahead of the hearing both sides agreed to ban Burgess from the property, which was ratified by the court.

The court also agreed to extend the SPO by another 12 months, the terms of which stipulate that the Stapletons, or anyone visiting or residing at the property, must not cause nuisance or annoyance within the locality, must not allow the property to be used for immoral or unlawful activity and must not be convicted of an indictable offence within the locality of the property.

The SPO will remain in place until January 7, 2019, and if the Order is breached within that time period, the Stapletons could face eviction from their home.

Following the conviction of Kiaran Stapleton for murder in 2011 we have worked very closely with Greater Manchester Police and the courts to prevent illegal activity within the locality of this property, and we hope that the exclusion of Burgess will help us achieve that aim.

We hope this case sends out a clear message that we take any breach of a Court Order very seriously and I’d like to reassure the community that we will be keeping a close eye on the Stapletons and if there are any further breaches of the Court Order they face a very real risk of eviction.

Salix Homes originally pursued legal action against Billie Jean and Anthony Stapleton after their son Kiaran Stapleton was convicted of murdering student Anuj Bidve, as well as months of criminal activity and anti-social behaviour at the property and in the locality.

Kiaran Stapleton was jailed for life in July 2012 and must serve a minimum of 30 years after he shot dead Anuj Bidve in Ordsall Lane, Salford, during the early hours of Boxing Day 2011.
